The Sectional Titles Schemes Management Act (STSMA), promulgated on 7 October 2016, introduced the concept of the Executive Managing Agent (EMA) as part of a broader move toward the professionalisation of sectional title scheme management. This framework enables a shift from a volunteer-based trustee model, typically operating with indemnity, to a more structured, accountable and professionally managed approach.
An Executive Managing Agent (EMA) may be appointed to assume the roles and responsibilities ordinarily carried out by the Board of Trustees. These responsibilities include, but are not limited to, financial management and budgeting, maintenance planning and execution, levy collection and recovery processes, rule enforcement, and the overall administrative and operational management of the scheme. These functions are critical to protecting and enhancing the value of the property and ensuring compliance with applicable legislation.
In today’s increasingly complex regulatory and operational environment, the role of trustees has become more demanding. Trustees are often required to make significant decisions while serving in a voluntary, part-time capacity, which can place considerable pressure on individuals who may not have the necessary time or specialised expertise.
Recognising these challenges, the STSMA provides, in terms of Prescribed Management Rule 28(1), that a Body Corporate may, by way of special resolution, appoint an Executive Managing Agent. This allows schemes to benefit from a higher level of professional oversight and consistent management.
